Principio de territorialidad y derecho aplicable en materia de patentes

Abstract

El objeto de la tesis es el estudio de las relaciones entre el principio de territorialidad y el derecho aplicable en materia de patentes. El estudio parte del análisis, fundamentación y funcionamiento del principio de territorialidad en los diferentes sectores normativos (convencional, comunitario y nacional). Posteriormente la tesis demuestra que la lex loci protectionis (derecho del estado para cuyo ámbito se solicita la protección) refleja el principio de territorialidad en el sector de la ley aplicable a las patentes, asumiendo unos caracteres particularmente diferenciados a las técnicas de derecho aplicable tradicionales. Precisamente, el principio de territorialidad significa que la "decisión" sobre la forma de reglamentación de los derechos de propiedades industrial se realiza dentro de cada estado conforme a la ley de ese estado. Con esta fundamentación, el operador jurídico esta obligado a respetar la configuración que de los derechos de propiedad industrial realice la lex loci protectionis, lo que obligara a considerar el derecho reclamado como un tipo de remisión integral. La lex loci protectionis puede reconocer derechos de propiedad industrial que hayan surgido en otro derecho y, en todo caso, la protección se restringe al territorio del estado de la protección.
