Abstract

Sobre la exoneración de deudas, en la Exposición de Motivos de la Ley 16/2022 se señala la importancia del reconocimiento del derecho a la exoneración de deudas desde un punto de vista macroeconómico, ya que “permite al deudor volver a emprender reincorporándose con éxito a la actividad productiva, (…)”. Así las cosas, a raíz de la transposición de la Directiva 2019/1023, sobre reestructuración e insolvencia, la exoneración del pasivo insatisfecho se constituye como un derecho del deudor, tal manera que las previsiones que supongan una limitación a tal derecho deben estar justificadas y ser objeto de interpretación restrictiva.
