El fin de la universalidad

Abstract

El libro que el Dr. Gutiérrez presenta al lector, presenta una articulación clara. Tras una primera parte en la que aborda los aspectos principales de la evolución histórica de la idea, su pre¬sencia en textos principales de Derecho positivo y alguna de las aportaciones doctrinales más significativas, procede posterior¬mente a una disección de las críticas que ha recibido –y recibe- la idea de universalidad de los derechos. En este sentido, propone una distinción, que ya se encuentra en otros autores como Antonio Pérez Luño, entre críticas filosóficas, políticas y jurídicas. La última parte del trabajo contiene una réplica detallada a los argumentos críticos expuestos con anterioridad, que bien puede ser considerada una crítica a las críticas. Y termina con una propuesta referida a la universalidad posible, en donde se reivindica una universalidad no fundamentalista con límites. El lector podrá constatar que se encuentra en presencia de un completo panorama que muestra las aristas principales del dis-curso sobre la universalidad de los derechos
