Abstract

El presente trabajo aborda la compleja realidad jurídico-penal y su concreta deriva punitiva desde una perspectiva causal, teniendo en cuenta la aportación multidisciplinar que realizan distintas ciencias sociales como la sociología, la economía, la criminología o el periodismo. Por ello, el análisis aborda la relación entre sociedad, medios de comunicación y legislador, dada su privilegiada posición legitimaria de la producción normativa, crucial en toda Democracia. Puesto que dicha interlocución conlleva una fuerte erosión del Estado de derecho, se observarán las concretas aportaciones que realiza cada actor, además de sus diferentes intereses; exponiendo así la conformación de las sociedades posmodernas, fuertemente influenciadas por el fenómeno de la globalización y el auge de la doctrina neoliberal, que tan preocupante cuestionamiento al Estado del bienestar realizan; así como el complejo proceso de construcción de la opinión pública. Siendo precisamente dichos factores los que están transformando el DP propiciando, en consecuencia, una reaccionaria y amenazante respuesta del legislador en contra del garantismo que debemos rechazar
