Abstract

[ES] El presente Trabajo de Fin de Máster se centra en el análisis del despido disciplinario en el ordenamiento jurídico español, una forma de finalización de la relación laboral particularmente delicada. Su origen se encuentra en un comportamiento grave y culpable por parte del trabajador, y su regulación se recoge principalmente en el Estatuto de los Trabajadores. A lo largo del estudio se abordan las causas que la ley contempla a la hora de justificar esta decisión empresarial, así como el procedimiento que el empleador debe seguir para que el despido sea conforme a derecho. Un aspecto especialmente relevante en la investigación es el reciente reconocimiento de la audiencia previa al trabajador, es decir, el derecho a ser escuchado con carácter previo al despido, reforzando así las garantías procedimentales. Finalmente, se examinan las posibles calificaciones judiciales del despido y sus consecuencias jurídicas, prestando especial atención al debate actual en torno a la indemnización por despido improcedente y su adecuación a los compromisos asumidos por España en virtud de la Carta Social Europea.

[EN] The present Master’s Thesis focuses on the analysis of disciplinary dismissal in the Spanish legal system, a particularly sensitive form of termination of employment. It stems from serious and culpable behaviour on the part of the worker, and is regulated mainly by the Workers' Statute. Throughout the study, the reasons that the law provides for this business decision are addressed, as well as the procedure that the employer must follow in order for the dismissal to be legal. One particularly relevant aspect in the investigation is the recent recognition of the prior hearing of the worker, that is to say, the right to be heard on a pre-dismissal basis, thus strengthening procedural guarantees. Finally, the possible judicial qualifications of the dismissal and its legal consequences are examined, paying particular attention to the current debate on compensation for unfair dismissal and its compliance with Spain’s commitments under the European Social Charter.
