Abstract

[ES] A raíz del auge del teletrabajo tras la pandemia de la COVID-19, se ha evidenciado un incremento en la exposición de las personas trabajadoras a factores psicosociales que generan consecuencias negativas para su seguridad y su salud, afectando también a la calidad y rendimiento en la prestación de servicios. Su identificación y evaluación y la planificación de acciones para prevenir los riesgos constituye una obligación para todos los empresarios, quienes deben cumplir con la legislación en la materia, tanto general, como específica para esta modalidad de prestación de servicios. En el presente trabajo, partiendo del concepto de riesgos psicosociales, se estudian las características principales del teletrabajo que pueden favorecer su aparición e intensificación, y, a continuación, se examina el régimen normativo aplicable, incluyendo la Ley 31/1995, de 8 de noviembre, de prevención de riesgos laborales (LPRL); la Ley 10/2021, de 9 de julio, de trabajo a distancia, y otras normas complementarias como el Real Decreto legislativo 2/2015, de 23 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto de los Trabajadores (ET) o la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales (LOPDGDD). Como valoración final, el trabajo concluye que, si bien el marco normativo actual reconoce la aplicación de la prevención de riesgos al teletrabajo, existen importantes desafíos prácticos y jurídicos que requieren una mayor adaptación y desarrollo específico para garantizar una protección efectiva de la salud psicosocial de los teletrabajadores.

[EN] As a result of the rise of telecommuting after the COVID-19 pandemic, there has been an increase in the exposure of workers to psychosocial factors that generate negative consequences for their safety and health, also affecting the quality and performance in the provision of services. Their identification and evaluation, as well as the planning of actions to prevent risks, is an obligation for all employers, who must comply with the legislation on this matter, both general and specific to this mode of service provision. In this paper, starting from the concept of psychosocial risks, the main characteristics of telework that can favor its emergence and intensification are studied, and then the applicable regulatory framework is examined, including Law 31/1995 of November 8, on the prevention of occupational risks (LPRL); Law 10/2021 of July 9, on remote work, and other complementary regulations such as Royal Legislative Decree 2/2015 of October 23, which approves the consolidated text of the Workers' Statute (ET) or Organic Law 3/2018 of December 5, on the protection of personal data and guarantee of digital rights (LOPDGDD). As a final assessment, the work concludes that, although the current regulatory framework recognizes the application of risk prevention to telework, there are significant practical and legal challenges that require further adaptation and specific development to ensure effective protection the psychosocial health of teleworkers.
