Abstract

[ES] Una vez más en seno de las normas paccionadas de naturaleza supraempresarial en España, es posible dar cuenta de cierto reparto de roles entre los convenios supraempresariales y los de empresa, pues los primeros hacen un llamamiento a los segundos para que ordenen o regulen el teletrabajo y, más específicamente, los derechos vinculados a los mismos. De esta manera, uno de los contenidos relativamente habitual en los convenios colectivos supraempresariales vinculados a la digitalización, en particular en aquellos sectores más intensivos en tecnología, consiste en una alusión significativa a la constitución de comisiones u observatorios cuya misión radica en analizar las condiciones de esta modalidad de prestación de servicios o en desarrollar procedimientos capaces de ordenar a nivel paccionado el funcionamiento del teletrabajo en el seno de las empresas. De esta manera, resulta posible señalar un doble cauce a través del cual se ordenan las relaciones entre convenios supraempresariales y de empresa a la hora de regular el teletrabajo a nivel de los diferentes sectores.
