[ES] La pena de prisión sigue ocupando un lugar muy importante dentro del sistema de penas del ordenamiento español. El vigente CP ha supuesto un cambio importante en la regulación de sistema de penas, pero las sucesivas reformas legislativas, guiadas por los idearios del punitivismo y de la expansión del DP, han llevado al uso excesivo y desproporcionado de la pena de prisión. Es cierto que el sistema penal cuenta con penas privativas de derechos que no afectan a la libertad ambulatoria, pero su utilización es moderada, acompañando como regla general a la pena privativa de libertad por excelencia, la prisión. En pleno siglo XXI es momento de reflexionar sobre el sistema de penas que ha establecerse, tomando en consideración los principios limitadores y legitimadores del ius puniendi, de manera muy especial el principio de proporcionalidad, para ampliar las alternativas a la pena de prisión, teniendo además presentes los efectos negativos que esta genera en el ser humano, y, en última instancia, porque los fines de prevención especial a los que esta pena se dirige por mandato de la CE también se pueden conseguir, y de manera más efectiva, a través de las medidas que tiene a su disposición el juez en la alternativa por excelencia en la actualidad, la suspensión de la ejecución de la pena privativa de libertad.
[EN] The prison sentence continues to occupy a very important place in the system of penalties in the Spanish legal system. The current Penal Code has brought about an important change in the regulation of the punishment system, but successive legislative reforms, guided by the ideals of punitivism and the expansion of the PD, have led to the excessive and disproportionate use of the prison sentence. It is true that the penal system has disenfranchising penalties that do not affect freedom of movement, but their use is moderate, accompanying as a general rule the custodial penalty par excellence, imprisonment. In the 21st century, it is time to reflect on the system of penalties that has been established, taking into consideration the limiting and legitimizing principles of ius puniendi, especially the principle of proportionality, in order to expand the alternatives to imprisonment, bearing in mind the negative effects it has on the human being, and, ultimately, because the purposes of special prevention to which this penalty is directed by mandate of the EC can also be achieved, and more effectively, through the measures available to the judge in the alternative par excellence at present, the suspension of the execution of the custodial sentence.
