Abstract

[ES] El presente Trabajo de Fin de Máster tiene como propósito principal el estudio de la prueba indiciaria y su importancia en el contexto judicial, especialmente en el ejercicio de la función jurisdiccional llevada a cabo por jueces y magistrados durante el proceso de enjuiciamiento. Dado que la legislación procesal ofrece una regulación limitada sobre este tipo de prueba, el trabajo se centra en el tratamiento de los indicios a lo largo de los distintos órdenes jurisdicciones en lo que respecta a los requisitos para su validez, provenientes de la interpretación jurisprudencial, a lo que se añade el análisis de la doctrina especializada. El estudio subraya la relevancia de la prueba indiciaria en la determinación de los hechos que constituyen el objeto del proceso, mostrando que, según la jurisprudencia consolidada, es posible llegar a una convicción judicial firme basándose en los indicios, sin que ello suponga una vulneración de los derechos fundamentales y dentro de los márgenes establecidos por el ordenamiento jurídico.

[EN] The main purpose of this Master's Thesis is to study circumstantial evidence and its importance within the judicial context, particularly in the exercise of the jurisdictional function carried out by judges and magistrates during the trial process. Since procedural legislation offers limited regulation regarding this type of evidence, the thesis focuses on the treatment of inferences across various jurisdictional domains, with particular attention to the requirements for their validity, derived from jurisprudential interpretation, along with an analysis of specialized doctrine. The study highlights the relevance of circumstantial evidence in determining the facts that constitute the subject of the case, demonstrating that, according to consolidated jurisprudence, it is possible to reach a firm judicial conviction based on inferences, without violating fundamental rights and within the boundaries established by the legal framework.
