[EN] The Criminal Code regulates the abuse and the neglect of animals. The doctrine keeps expressing its doubts on what is the legal good protected through the criminalisation of these behaviours. Organic Law 1/2015, of 30 of March, has reformed these provisions introducing significant novelties with regard to the protection of animals. Thus, it has considerably expanded the number of animals that are covered by those criminal definitions; it has included the behaviour relating to sexual exploitation of animals; it has integrated specific aggravating circumstances partially matching those foreseen in Sections 148 and 149 of the Criminal Code for persons, distinguishing between the result of injury and the death of the animal; and has changed the content of the sentence of disqualification, now also referred to the possession of animals. In addition, this reforms entails the full repeal of the book III of the Criminal Code and the disappearance of criminal misdemeanours, so that now the misdemeanour of animals abuse foreseen in Section 632.2 of the Criminal Code and the abandonment of animals foreseen in Section 631.2 of the Criminal Code have become attenuated forms of an offence.

[ES] El Código Penal regula el maltrato y el abandono de animales. La doctrina sigue manifestando sus dudas en torno a cuál es el bien jurídico protegido a través de la tipificación de estas conductas. La LO 1/2015, de 30 de marzo, ha reformado estos preceptos introduciendo novedades significativas respecto de la protección de animales. Así, se ha ampliado considerablemente la relación de animales que quedan abarcados por los tipos; se ha incluido la conducta relativa a explotación sexual de animales; se han incorporado agravantes específicas coincidentes parcialmente con las previstas en los arts. 148 y 149 CP para las personas, diferenciándose entre el resultado de lesión y la muerte del animal; y se ha modificado el contenido de la pena de inhabilitación, referida ahora también a la tenencia de los animales. Además, al suponer la reforma la derogación completa del Libro III CP, desapareciendo las infracciones penales constitutivas de falta, tanto la falta de maltrato a animales del art. 632.2 CP, como el abandono de animales del art. 631.2 CP han pasado a constituir modalidades atenuadas de delito.
