Abstract

[ES] La reciente resolución del TJUE en el caso Ca Na Negreta ha cambiado la forma en que las empresas determinan la continuación de la relación laboral con las personas trabajadoras a las que se les ha reconocido una IP. A partir de ahora no se podrá extinguir el contrato de trabajo de manera automática tras la declaración de la IP de la persona trabajadora en virtud del artículo 49.1 del ET. Esta opción unilateral de terminación de la relación laboral por la sola declaración de IP va en contra de diversas normativas, por lo que ahora las empresas deben hacer cumplir unos requisitos previos antes de ponerle fin. La resolución administrativa del INSS ya no es suficiente para dar por finalizada la relación laboral, y las empresas tendrán que llevar a cabo los ajustes razonables adecuados en el puesto de trabajo, siempre que ello sea posible.

[EN] The recent judgment of the CJEU in the Ca Na Negreta case has swifted the way companies determine the continuation of the employment relationship with employees who have been recognized with a permanent disability. From now on, the employment contract cannot be automatically terminated following the recognition of permanent disability of the employee under article 49.1 of the ET. This unilateral choice of terminating the employment relationship based solely on the declaration of permanent disability goes against various regulations, so now companies must meet certain requirements before ending it. The administrative decision of the INSS is no longer sufficient to terminate the employment relationship, and companies will have to carry out appropriate reasonable adjustments in the workplace, whenever possible.
