[ES] El número de matrimonios entre extranjeros y españoles han aumentado considerablemente en las últimas décadas debido a la inmigración. Ante este aumento, se ha observado la práctica de simular un matrimonio para obtener los beneficios de esta institución en materia de nacionalidad y extranjería. Esta simulación recibe el nombre de matrimonio de conveniencia. Con el fin de evitar que sigan aumentando los matrimonios de conveniencia y de ofrecer soluciones, la Dirección General de la Seguridad Jurídica y Fe publica ha creado una serie de instrucciones para detectar y prevenir los matrimonios de conveniencia en España. El objetivo de este trabajo es realizar un análisis sobre los matrimonios de conveniencia, para ello comenzaremos con el análisis del matrimonio tanto como derecho y como institución, así como de los requisitos que se exigen para su validez. A continuación, profundizaremos en los matrimonios de conveniencia, explorando los indicios que los caracterizan y las ventajas que esta institución proporciona a ambos contrayentes. Por último, examinaremos las principales medidas para combatir este tipo de matrimonio.

[EN] The number of marriages between foreigners and Spaniards has increased considerably in recent decades due to immigration. In view of this increase, the practice of simulating a marriage has been observed in order to obtain the benefits of this institution in terms of nationality and foreigners. This simulation is known as a marriage of convenience. In order to avoid a further increase in marriages of convenience and to offer solutions, the legislator has drawn up a series of instructions to detect and prevent marriages of convenience in Spain. The aim of this work is to analyse marriages of convenience, starting with ananalysis of marriage as a law and as an institution, as well as the requirements for its validity. Next, we will delve deeper into marriages of convenience, exploring the signs that characterize them and the advantages that this institution provides to both parties. Finally, we will examine the main measures to combat this type of marriage.
