Abstract

[ES] Las penas más graves que se contemplan en los ordenamientos jurídicos son las de muerte, de cadena perpetua y prisión permanente revisable. Además, de estudiar su efectividad en relación con los distintos fines de la pena (enfatizando sobre todo en el efecto preventivo general negativo, intimidatorio o disuasorio), en este trabajo se intentará responder a por qué la sociedad parece ser proclive a la imposición de estos castigos tan severos e inhumanos. Para ello se analizará el concepto mismo de pena y los fines que estas persiguen, para así introducir el estudio posterior de los argumentos a favor y en contra de la pena de muerte, el debate en torno a la cadena perpetua, y las razones de la posible inconstitucionalidad material de la prisión permanente revisable, sustituta de las dos anteriores. Siendo esta última la única vigente actualmente en nuestro país, se ofrecerán también algunas alternativas para el aparente vacío que podría provocar su supresión, obligada si se acepta que existen otros métodos menos duros para llegar a conseguir los mismos resultados de protección de bienes jurídicos. Todo ello se hará no solo a través de opiniones de la doctrina, sino también con datos estadísticos y narraciones de casos reales para contextualizar algunos temas.

[EN] The most serious penalties contemplated in legal systems are death penalty, life imprisonment, and reviewable permanent imprisonment. In addition to studying their effectiveness in relation to the different purposes of punishment (emphasizing mainly on the negative general preventive, deterrent, or dissuasive effect), this work will attempt to answer why society seems inclined to impose such severe and inhumane punishments. To do so, the very concept of punishment and its pursued objectives will be analyzed, in order to subsequently delve into the arguments for and against the death penalty, the debate surrounding life imprisonment, and the reasons for the possible material unconstitutionality of reviewable permanent imprisonment, which replaces the previous two. Since the latter is currently the only penalty in force in our country, some alternatives will also be presented to address the apparent void that its abolition could cause, assuming that there are other less harsh methods to achieve the same results in protecting legal interests. All this will be done not only through doctrinal opinions but also with statistical data and narratives of real cases to contextualize certain issues.
