Abstract

[ES] El principal objetivo de este trabajo es analizar los entresijos del suicidio como accidente de trabajo. Para ello, vamos a analizar diversas resoluciones judiciales para ver que postura ha adoptado la doctrina en cada caso si falla la presunción de laboralidad del artículo 156 de la Ley General de Seguridad Social. Al mismo tiempo, se expondrán los distintos riesgos psicosociales dentro del ambiente laboral que pueden afectar a la salud mental de los trabajadores, haciendo mención a distintas investigaciones que varios organismos han realizado para prevenir el suicidio en diferentes ámbitos. Ante un tema tan complejo y delicado, cada vez son más las empresas en adoptar medidas de protección en relación a la salud mental velando así por la seguridad y salud de todos sus trabajadores.

[EN] The main objective of this project is to analyse the intricacies of suicide as an accident at work. To do this, we will analyse various court decisions to see what stance the doctrine has adopted in each case if the presumption of work-relatedness of article 156 of the General Law on Social Security fails. At the same time, the different psychosocial risks within the work environment that can affect the mental health of workers will be presented, mentioning different research that various organizations have carried out to prevent suicide in different areas. Faced with such a complex and delicate issue, more companies are adopting protective measures in relation to mental health, thus ensuring the health and safety of all their workers.
