[ES] La compleja normativa que regula el sistema de la Seguridad Social en el marco español en lo que concierne a la prestación de Incapacidad Temporal, así como las diversas consecuencias que se generan, como es el absentismo injustificado, es lo que justifica el estudio de los aspectos más relevantes de la prestación y su control establecido con la finalidad de reducir las situaciones de absentismo injustificado. El objetivo de este trabajo, es el de analizar el funcionamiento y los diferentes aspectos que regulan la prestación de Incapacidad Temporal, haciendo un breve recorrido en cuanto a los caracteres generales, requisitos para acceder a la misma y su dinámica. Una vez analizado los rasgos generales que definen a esta prestación, se centra el estudio en el control que debe recibir una prestación tan utilizada por parte de los trabajadores, merecedora, por tanto, de un control exhaustivo con el fin de evitar un uso abusivo e inadecuado de la misma. Dicho control se hace necesario debido a la pérdida económica que repercute en nuestro sistema de Seguridad Social, derivado del absentismo y del fraude que en determinadas ocasiones se produce por parte del trabajador como mecanismo alternativo a la situación de desempleo.

[EN] The complex regulations ruling the Social Security system in the Spanish framework with regard to the Temporary Incapacity benefit, as well as the diverse consequences derived from it, such as unauthorised absenteeism, is what justifies the study of the most relevant aspects of the benefit and its control with the aim of reducing unjustifies absentteeism. The purpose of this paper is to analyse the functioning and the different aspects that regulate the Temporary Incapacity allowance, making a brief overview of its general characteristics, the requirements for accessing it and its dynamics. Once the general features that define this benefit have been analysed, this study focuses on the control that should be exercised overa a benefit that is so widely used by workers, and which therefore deserves close monitoring in order to avoid its abusive and inappropriate use. This supervision is necessary due to the financial cost that affects our Social Security system as a result of absenteeism and the fraud that may sometimes occur on the part of the worker as an alternative mechanism to unemployment.
