Abstract

Desde comienzos de la década de los años noventa, la Comunidad Europea ha tratado de armonizar el derecho sustantivo de protección de invenciones biotecnológicas a través de la patente. El primer intento de normativa comunitaria ni siquiera llegó a ver la luz, por falta de acuerdo entre las instituciones. En el segundo intento, la Directiva 98/44/CE se ha visto obstaculizada tanto en su proceso de aprobación como en el de transposición a los ordenamientos nacionales, dando lugar a la interposición de un recurso de nulidad y a varios procesos de incumplimiento.Entre las cuestiones más debatidas, y que ha dado lugar a mayores dudas, se encuentra la de la patente sobre elementos aislados del cuerpo humano.
