La huelga en los servicios esenciales de la comunidad = The right to strike in community's essential services

Abstract

La Constitución de 1978 recoge el derecho de los trabajadores a la huelga, para la defensa de sus intereses, como un derecho fundamental y subjetivo. Sin embargo, el artículo 28 de la Constitución establece la necesidad de tener en cuenta que la ley que regule el ejercicio de este derecho deberá establecer las garantías precisas para asegurar el mantenimiento de los servicios esenciales de la comunidad, sin que en ningún caso se sobrepase el contenido esencial del derecho de huelga o se haga impracticable. A la hora de fijar qué se debe entender por servicios esenciales, habrá que estar, sobre todo, a la jurisprudencia del Tribunal Constitucional. De dicho referente se desprende que la esencialidad de un servicio depende del resultado alcanzado, que debe consistir en la satisfacción de derechos fundamentales, libertades públicas y bienes constitucionalmente protegidos. Una vez que se ha considerado un sector o actividad como esencial, es necesario establecer aquellas medidas que se consideren necesarias para garantizar el funcionamiento de esos servicios, conocidas como servicios mínimos. Para garantizar el cumplimiento de dichos servicios se deben fijar aquellos trabajadores que los deben realizar, quienes de no acatar la orden empresarial pueden incurrir en determinados supuestos de responsabilidad.
