Abstract

El presente trabajo analiza la figura jurídica de la ultraactividad, así como los problemas interpretativos generados por la nueva redacción del artículo 86.3 del ET dada por la Ley 3/2012, tras la última reforma laboral. Se comienza con un breve estudio sobre la evolución jurídica para poder entender su nueva configuración y se continúa con el análisis de los problemas derivados de la falta de ultraactividad. Se examinan los tres grandes escenarios de incertidumbre desde el punto de vista de la doctrina tanto científica como judicial, para poder conocer cómo se ha entendido la regla “salvo pacto en contrario” y cómo ha afectado la misma a los pactos de ultraactividad anteriores a la reforma de 2012; cómo se ha interpretado el convenio colectivo de ámbito superior; qué sucede cuando no existe la red protectora del convenio colectivo de ámbito superior y las dos posturas formadas al respecto. Por último, se analizará la tan relevante y criticada sentencia del Tribunal Supremo de 22 de diciembre de 2014, así como sus votos particulares, las consecuencias derivadas de la aceptación de la contractualización originaria y universal de las condiciones de trabajo y, por último, algunas de las críticas de la doctrina científica a la postura adoptada por la sentencia.
