Abstract

En este Trabajo de Fin de Grado se pretende estudiar los beneficios fiscales aplicados por las distintas Comunidades Autónomas en el Impuesto sobre Transmisiones Patrimoniales y Actos Jurídicos Documentados (en delante, ITPAJD) a las familias numerosas en relación con el derecho de acceso a una vivienda digna ya que su especial naturaleza les hace acreedoras de una protección preferente. Esto plantea no pocos problemas porque es un impuesto cedido totalmente a las Comunidades Autónomas (en adelante también CCAA), de carácter objetivo y que no debería tener en cuenta las circunstancias personales del sujeto pasivo para la determinación de su cuota; pese a ello, la utilización de esta figura resulta común en casi todas las CCAA. Para ello, es necesario conceptualizar en primer término qué es una familia numerosa desde su configuración por el Derecho privado, analizando los requisitos exigidos legalmente para obtener tal calificación; posteriormente, nos adentramos en la subjetivación que se ha producido en este impuesto, así como en la justificación legal que da nuestro ordenamiento a la posibilidad de este tipo de beneficios. Finalmente, por ser un impuesto cedido, también se estudian aquí los diversos beneficios que cada autonomía ha previsto para las familias numerosas.
