Abstract

A lo largo del presente trabajo se exponen las peculiaridades del trabajo en el sector agrícola, analizando, en primer lugar, sus normas reguladoras como convenios de la OIT, normativa comunitaria, normativa nacional y su negociación colectiva. A continuación, se profundiza en las formas contractuales más frecuentes para este sector, como son el contrato de obra y servicio o temporeros que es el contrato con diferencia más usado en este sector debido a su estacionalidad y a la hora de necesitar a muchos trabajadores para tareas especificas. El trabajo eventual dado por un aumento de tareas, la jurisprudencia ha admitido este tipo de contrato cuando al trabajador se le requiere año tras año; y por último el trabajo fijo-discontinuo siendo el menos usado en este sector por no poder repetir las fechas año tras año. También se analizan los factores de riesgo que afectan principalmente a los trabajadores del sector y las principales medidas preventivas a adoptar, sin dejar de analizar el sistema especial en la Seguridad Social de los trabajadores por cuenta ajena, cuya principal característica son los periodos de actividad e inactividad. Atendiendo a la situación tan excepcional provocada por el COVID-19 se han incorporado medidas de apoyo por el ministerio de Agricultura, Pesca y Alimentación facilitándoles el trabajo en esta crisis y ayudas que ha recibido este sector clasificándole como esencial para superar esta crisis.
