Abstract

La imparcialidad de los peritos constituye una de las garantías esenciales del proceso, integrada en el derecho fundamental a un juicio justo del art. 24.1 CE. Es necesario que el dictamen emitido por el perito sea veraz, pero además el perito debe ser objetivo. Debe emitir su pericial atendiendo a los datos objetivos que tenga para hacerlo, sin que pueda influir en sus conclusiones o métodos utilizados, ni en ningún otro extremo de su actividad pericial, razón subjetiva alguna. Imparcialidad, objetividad y neutralidad son obligaciones del perito. La LEC trata de asegurar que el perito en el desempeño de su cargo sea imparcial, es decir, que su participación en el proceso sea objetiva, desinteresada y provocada sólo por sus conocimientos especiales y no por su relación con los hechos que se van a enjuiciar o el vínculo con las partes. Como explicaremos a lo largo de nuestro trabajo, la imparcialidad del perito de parte es una cuestión especialmente controvertida. Entre los mecanismos para controlar la imparcialidad del perito la legislación española prevé un mecanismo común a todo perito que es el juramento o promesa de actuar con objetividad, un mecanismo específico para el perito de parte, que es la tacha, y dos mecanismos específicos para el perito de designación judicial, que son la abstención y la recusación.
