Abstract

El presente trabajo que lleva por título “La protección de las obtenciones vegetales en el derecho español”, tiene por objeto el estudio de las obtenciones vegetales en los diferentes ámbitos normativos, así como la importancia de la existencia de un sistema de protección del derecho de los obtentores de variedades. La elección de este tema obedece a la importancia creciente que las obtenciones vegetales tienen en las diferentes actividades económicas que el hombre desarrolla y que en particular aparecen especialmente vinculadas con los sectores agrario, industrial e incluso ornamental, entre otros. Las plantas como elemento de la naturaleza han estado y están vinculadas a la existencia del ser humano en el desarrollo de su ciclo vital. Por lo tanto, debido a este creciente protagonismo que las variedades vegetales tienen esto hace que los diferentes programas de investigación que tienen por objeto la creación de nuevos vegetales sean más numerosos y se inviertan importantes sumas de dinero, así como recursos humanos y técnicos. Sin duda, esta labor investigadora sobre la materia vegetal y las plantas, es merecedora de la correspondiente tutela y protección por parte de los diferentes ámbitos normativos, se ha materializado así a través del derecho de obtención vegetal y la patente.
