Abstract

El trabajo de Fin de Máster que a continuación se les presenta versa sobre el despido disciplinario por transgresión de la buena fe contractual como consecuencia del uso indebido de los medios tecnológicos en el trabajo. En el mismo se realiza en un primer momento una visión genérica sobre el despido disciplinario basado en la transgresión de la buena fe contractual.No obstante, el trabajo se centra principalmente en el despido disciplinario como consecuencia del uso con fines no laborales por parte del trabajador de los medios tecnológicos puestos a su disposición por el empresario.Esta conducta encaja dentro de la figura de la transgresión de la buena fe contractual. Sin embargo, la normativa es muy concisa y no es muy extensa al respecto, motivo por el cual ha sido la jurisprudencia quien ha asentado las bases y requisitos.Por ello, y tras analizar la normativa y la jurisprudencia, se ha llevado a cabo un repaso de las distintas situaciones que pueden darse, los requisitos para sancionar dichas conductas, las maneras de proceder, etc. con el fin de elaborar, en cada uno de los apartados, una guía útil que permita asesorar jurídicamente a quien pretenda, bien sancionar estas conductas, bien regular su uso por parte de los trabajadores
