Abstract

Dentro del concepto de accidente de trabajo existen diversas tipologías del mismo. Entre ellas, se encuentra el caso particular del accidente in itinere, es decir, el ocurrido al ir o al volver del lugar de trabajo.Este tipo de accidente de trabajo tiene una gran importancia, por las lesiones que genera y la gran incidencia en una sociedad, como la actual, en la que la mayoría de sus miembros precisan de un medio de transporte para acudir a su puesto de trabajo. Su ambigua delimitación normativa provoca que para determinar su existencia sea preciso delimitar la relación de causalidad entre el accidente y la lesión.El accidente in itinere es de marcado carácter jurisprudencial, puesto que su definición legal es escasa y ha sido completada por la gran casuística existente en la materia.No podía ser menos la dificultad concerniente al enfoque preventivo de este tipo de accidente, ya que el riesgo a proteger es un riesgo que escapa del control del empresario, ya que ocurre fuera de las dependencias de la empresa y normalmente son importantes en su aparición, circunstancias ajenas al propio trabajo, como puede ser el estado de la vía, las condiciones personales del trabajador, etc.
