Abstract

Este Trabajo de Fin de Grado ha tenido como objetivo analizar el tratamiento de la reincidencia, la multirreincidencia, la habitualidad y otras manifestaciones de reiteración delictiva que aparecen en diferentes preceptos del CP, supuestamente como respuestas específicas frente a los delincuentes peligrosos criminalmente, con mayor presencia en el Texto Punitivo desde que se aprobara su texto inicial en el año 1995.A lo largo del trabajo se ponen de manifiesto los problemas de legitimidad e incluso, la constitucionalidad de las circunstancias de reincidencia y multirreincidencia, así como los problemas teóricos y prácticos que plantea la regulación específica de esta circunstancia para determinados delitos contra el patrimonio.También se pone de relieve que tales soluciones —incremento de la penalidad— pueden resultar inadecuadas y poco operativas para el tratamiento de la reiteración delictiva, resultando no menos adecuado, a la vista de la regulación positiva, el recurso a las medidas de seguridad en casos muy concretos.Se ha tratado de averiguar si hay alguna razón que explique este distinto tratamiento en materia de consecuencias jurídicas previsto en el CP para los delincuentes “presuntamente” peligrosos criminalmente, que sea respetuoso con el DP del hecho y, en esa medida, no sea una mera manifestación de planteamientos teóricos extendidos desde hace varias décadas que están poniendo en riesgo la forma de entender el DP garantístico propio de un Estado de Derecho
