Abstract

En este Trabajo de Fin de Grado hemos estudiado lo relativo a las exenciones tributarias y más concretamente, a las exenciones contempladas en la Ley del Impuesto sobre la Renta de las Personas físicas.Sin embargo, lo que más interés nos ha causado para este trabajo es la prestación de maternidad otorgada por la Seguridad Social ya que, en el pasado año, el año 2018, numerosas sentencias debatieron sobre la posible exención de dicha prestación. Mencionado debate acaba con el pronunciamiento del Tribunal Supremo en la sentencia de 3 de octubre de 2018.El legislador, por su parte, también hizo honor a su papel realizando dos reformas que ponen de manifiesto la intención del Tribunal Supremo, acabando aún más con la discusión que hasta el momento había existido.Finalmente, para aquellos afectados por el fallo de la sentencia se abre un procedimiento con el fin de que puedan solicitar aquellos que les corresponde
