Abstract

La evidencia electrónica puede ser frágil por naturaleza, es decir, puede ser alterada, manipulada o destruida a través del manejo o examen inadecuado. Por ello, es de vital importancia ser meticulosos durante el proceso de capturas de evidencias electrónicas, ya que, si no se manejan de la manera apropiada, éstas pueden resultar inválidas en un proceso judicial. Toda evidencia digital tiene que ser veraz y auténtica, por ello no hay mejor manera para demostrarlo que capturándola tal y como es. El objetivo de este TFM es generar evidencias legalmente válidas sobre páginas web, cumpliendo con las normas vigentes y el buen hacer pericial sobre evidencias electrónicas, con el fin de demostrar que ciertos contenidos estaban publicados en un tiempo determinado, quedando demostrada su autenticidad. En este TFM se han analizado los requisitos necesarios y se ha desarrollado un sistema para la captura de evidencias electrónicas de páginas web, con el propósito de poder aportarlas como pruebas en una investigación y asegurando en todo momento la integridad de éstas, haciendo uso del sellado de tiempo.

L'evidència electrònica pot ser fràgil per naturalesa, és a dir, pot ser alterada, manipulada o destruïda a través del maneig o examen inadequat. Per això, és de vital importància ser meticulosos durant el procés de captures d'evidències electròniques, ja que, si no es manegen de la manera apropiada, aquestes poden resultar invàlides en un procés judicial. Tota evidència digital ha de ser veraç i autèntica, per això no hi ha millor manera per demostrar-ho que capturant tal com és. L'objectiu d'aquest TFM és generar evidències legalment vàlides sobre pàgines web, complint amb les normes vigents i el bon fer pericial sobre evidències electròniques, amb la finalitat de demostrar que certs continguts estaven publicats en un temps determinat, quedant demostrada la seva autenticitat. En aquest TFM s'han analitzat els requisits necessaris i s'ha desenvolupat un sistema per a la captura d'evidències electròniques de pàgines web, amb el propòsit de poder aportar com a proves en una investigació i assegurant en tot moment la integritat d'aquestes, fent ús del segellat de temps.

Electronic evidence can be fragile by nature, that is, it can be altered, manipulated or destroyed through improper handling or examination. Therefore, it is vitally important to be meticulous during the process of capturing electronic evidence, since, if not handled properly, they may be invalid in a judicial process. All digital evidence has to be truthful and authentic, so there is no better way to prove it than by capturing it as it is. The objective of this TFM is to generate legally valid evidence on web pages, complying with current regulations and good expert work on electronic evidence, in order to demonstrate that certain contents were published at a certain time, demonstrating their authenticity. In this TFM, the necessary requirements have been analyzed and a system for capturing electronic evidence from web pages has been developed, in order to provide them as evidence in an investigation and ensuring their integrity at all times, making use of the seal of time.
