La residencia fiscal de las personas físicas es una piedra angular de la potestad tributaria de los distintos Estados y un elemento básico sobre el que se sustenta y pivota la fiscalidad internacional. Dada su relevancia, y más entre países colindantes que presentan importantes diferencias al respecto, el principal objetivo del presente trabajo es realizar un análisis comparado de su regulación entre España y Portugal, tanto para clarificar su distinta configuración y la actual aplicación de los distintos criterios para determinarla, como para identificar y analizar los principales problemas que se presentan (especialmente ante el contexto actual, caracterizado por la creciente movilidad internacional).
The tax residence of individuals is a cornerstone of the States» tax power and a basic element in international taxation. Given its relevance, and especially between neighboring States that present notable differences in this regard, the main objective of this study is to carry out a comparative analysis of the Spanish and Portuguese regulations, both to clarify its different configuration and the current application of each of the criteria that entail this condition in each State, and to determine and analyze the main problems that they present (especially in the current context, characterized by the increase of international mobility).
