Arbitraje y la propiedad industrial en Chile

Abstract

El presente trabajo tiene como objetivo proveer de un punto de partida a la discusión sobre el arbitraje y la propiedad industrial en Chile. Con este propósito, el estudio se aboca, por una parte, a la revisión del estado actual de los derechos de Propiedad Industrial y la creciente importancia de su desarrollo a nivel regional, y por otra, al estudio del arbitraje como mecanismo de resolución de estos conflictos. En este escenario, se describen las particulares ventajas y desafíos que representa el arbitraje para la resolución de las controversias que involucran derechos de PI. Finalmente, se profundiza en el estudio de la arbitrabilidad en Chile, identificándolo como un elemento clave para su promoción.

The purpose of this paper is to provide a starting point for the discussion on arbitration and industrial property in Chile. To this end, the study focuses on the one hand, on the review of the current state of industrial property rights and the growing importance of their development at the regional level, and on the other hand, on the study of arbitration as a mechanism for the resolution of these conflicts. In this scenario, the particular advantages and challenges that arbitration represents for the resolution of disputes involving IP rights are described. Finally, it delves into the study of arbitrability in Chile, identifying it as a key element for its promotion.
