El aplazamiento y fraccionamiento de las deudas tributarias como instrumento para el mantenimiento de las empresas

Abstract

La finalidad del aplazamiento y fraccionamiento es la de facilitar el cumplimiento de la obligación de pago de las deudas tributarias mediante la concesión de un nuevo plazo (aplazamiento) o bien posibilitando el pago por partes (o fracciones), si se cumplen determinados requisitos, cuando concurre una situación transitoria de dificultad económica. Con lo cual, es un mecanismo del que pueden beneficiarse las empresas y empresarios en momentos críticos para intentar mantener su actividad empresarial. Tras la presentación de una solicitud de aplazamiento o fraccionamiento, la Administración deberá admitirla a trámite, salvo defectos de forma o que se trate de deudas no aplazables, y procederá a su examen valorando si concurren los requisitos legalmente establecidos para su concesión. En este contexto, las posibles causas de desestimación son la inexistencia de una situación económico-financiera que impida realizar el pago, que la dificultad para el pago no sea de carácter transitorio, que no se presenten garantías suficientes o bien que no se cumplan los requisitos que exceptúan el deber de aportación de garantías. Por todo ello, resulta fundamental analizar qué deudas no son aplazables o fraccionables y los requisitos exigidos para la concesión del aplazamiento o fraccionamiento, así como el procedimiento a seguir para su concesión y denegación, prestando atención a los efectos que se derivan tanto de la presentación de la solicitud como de la resolución administrativa que se acabe dictando.

The purpose of deferral and fractionation is to facilitate the fulfillment of the obligation to pay the tax debts by granting a new term (deferral) or by enabling the payment in parts (or fractions), if certain requirements are met, when there is a transitional situation of economic difficulty. Therefore, it is a mechanism that benefits companies and entrepreneurs at critical times to try to maintain their business activity. After the presentation of a request for deferral or fractionation, the Administration must admit it to processing, except for defects in form or that they are non-deferrable debts, and will proceed to its examination assessing whether the legally established requirements for its granting are met. The possible reasons for refusal are the absence of an economic situation that prevents payment from being made, that the difficulty in payment is not of a transitional nature, that sufficient guarantees are not presented or that the requirements that exempt the duty to provide guarantees are not met. Therefore, it is essential to analyze which debts are not deferrable or fractionable and the requirements required for the granting of the deferral or fractionation, as well as the procedure to be followed for its granting and refusal, paying attention to the effects that derive both from the presentation of the application and from the administrative resolution that ends up being issued.
