Los cuidados como derecho fundamental

Abstract

En los últimos tiempos, el cuidado ha pasado a ser un tema central objeto de las políticas públicas de gran parte de países del mundo, principalmente del mundo occidental. La gran mayoría de ellos plantean estrategias de cuidados, principalmente de cuidados de larga duración y ello, debido a la evolución demográfica de la población. España no se queda atrás y se encuentra actualmente elaborando su estrategia estatal de cuidados para lo que cuenta con una Hoja de ruta1. Sin embargo, no se ha planteado, por el momento, la necesidad de abordar el asunto en su conjunto desde el plano jurídico, esto es, la consideración de la creación de un nuevo derecho de cuidados. En el presente trabajo se trata de avanzar en un posible marco para la creación del derecho de cuidados (a cuidar y ser cuidado), teniendo presente que se trataría de un nuevo derecho social, subjetivo y universal, por tanto, de carácter fundamental que contara con las garantías constitucionales para su ejecución. La determinación del concepto resulta compleja debido al enorme alcance y significado que tiene para toda persona a lo largo de su vida, no obstante, en el intento de otorgar mayor determinación al derecho y dada la legislación existente relacionada con el posible derecho, se realiza una aproximación a la conceptualización del mismo.

En els últims temps, la cura ha passat a ser un tema central objecte de les polítiques públiques de gran part de països del món, principalment del món occidental. La gran majoria d'ells plantegen estratègies de cures, principalment de cures de llarga durada i això, a causa de l'evolució demogràfica de la població. Espanya no es queda enrere i es troba actualment elaborant la seva estratègia estatal de cures per al que compta amb una Fulla de ruta1. No obstant això, no s'ha plantejat, de moment, la necessitat d'abordar l'assumpte en conjunt des del pla jurídic, això és, la consideració de la creació d'un nou dret de cures. En el present treball es tracta d'avançar en un possible marc per a la creació del dret de cures (a cuidar i ser cuidat), tenint present que es tractaria d'un nou dret social, subjectiu i universal, per tant, de caràcter fonamental que comptés amb les garanties constitucionals per a la seva execució. La determinació del concepte resulta complexa a causa de l'enorme abast i significat que té per a tota persona al llarg de la seva vida, no obstant això, en l'intent d'atorgar major determinació al dret i donada la legislació existent relacionada amb el possible dret, es realitza una aproximació a la conceptualització d'aquest.

In recent times, care has become a central issue in the public policies of many countries around the world, especially in the West. The vast majority of these countries have developed care strategies, mainly for long-term care, due to the demographic evolution of the population. Spain is not lagging behind and is currently developing its national care strategy, for which it has a roadmap. However, the need to address the whole issue from a legal perspective, i.e., the consideration of the creation of a new right to care, has not yet been raised. This paper attempts to advance a possible framework for the creation of the right to care (to care and to be cared for), bearing in mind that it would be a new social, subjective and universal right, and therefore of a fundamental nature, with constitutional guarantees for its implementation. Determining the concept is complex due to the enormous scope and meaning that it has for every person throughout their lives; however, in an attempt to give greater determination to the right and given the existing legislation related to the possible right, an approximation to its conceptualisation is made.
