Elements ambientals en la fiscalitat de l'automòbil i dumping fiscal territorial

Abstract

En el presente trabajo, a partir del supuesto práctico de una empresa ficticia de alquiler de vehículos de lujo con chófer, examinaremos la tributación del automóvil en España prestando atención a aquellos impuestos en que su régimen jurídico permite a los entes territoriales modificar, en todo o en parte, su regulación y generar una presión fiscal diversa entre diferentes ámbitos territoriales dentro del mismo país. Observaremos así en qué medida la ordenación de impuestos propios o no armonizados en su totalidad puede derivar en situaciones de dumping fiscal territorial que, si bien ya es objeto de polémica en impuestos con finalidad puramente recaudatoria, posee una trascendencia moral más significativa cuando la finalidad de estos es un beneficio global como la defensa del medio ambiente.

In the present work, from the practical assumption of a fictitious luxury car rental company with driver, we will examine the taxation of automobiles in Spain paying special attention to those taxes in which its legal regime allows territorial governments to modify partial or totally its regulation, fact that generates a diverse taxation between different territorial areas within the same country. We will observe to what extent the establishment of territorial specific taxes or non-harmonized state taxes in their entirety may lead to situations of territorial fiscal competition that, although it has already been the subject of controversy in taxes witch exclusively collecting purposes has a greater moral significance when its purpose is a global benefit such as environmental protection.

Al present treball, a partir del supòsit pràctic d'una empresa fictícia de lloguer de vehicles de luxe amb xofer, examinarem la tributació de l'automòbil a Espanya prestant atenció a aquells impostos en que el seu règim jurídic permet als ens territorials modificar, en tot o en part, la seva regulació i generar una pressió fiscal diversa entre diferents àmbits territorials dintre del mateix país. Observarem així en quina mesura l'ordenació d'impostos propis o no harmonitzats en la seva totalitat pot derivar en situacions de dumping fiscal territorial que, si bé ja és objecte de polèmica en impostos amb finalitat purament recaptadora, posseeix una transcendència moral més significativa quan la finalitat d'aquests és un benefici global com la defensa del medi ambient.
