Sankcja kredytu darmowego w ustawie o kredycie konsumenckim

Abstract

Na rynku kredytu konsumenckiego w Polsce dochodzi do dość częstych nadużyć. Zdarza się, że kredytodawcy wykorzystując swoją silniejszą pozycję doprowadzają do kształtowania praw i obowiązków konsumentów na ich znaczną niekorzyść, a także nie dopełniają ciążących na nich obowiązków informacyjnych. Tym samym ustawodawca zdecydował o wprowadzeniu w 2001 roku do polskiego systemu prawa sankcji polegającej na pozbawieniu kredytodawcy przewidywanego zysku. Sankcja kredytu darmowego ma na celu odstraszenie kredytodawców od dokonywania naruszeń, przez co przeciętny konsument objęty jest ochroną przed nierzetelnym działaniem kredytodawcy w ramach zawieranej z nim umowy o kredyt konsumencki. Jednocześnie dopiero od pewnego czasu da się zauważyć rosnącą tendencję do częstszego stosowania sankcji w orzecznictwie sądów. Przedmiotem pracy jest analiza powołanej sankcji zarówno w doktrynie jak i orzecznictwie. W niniejszym artykule stawia się pytania co do praktycznego jej zastosowania a także podejmuje polemikę z dotychczasowym dorobkiem doktryny w tym zakresie.

There are many abuses which take place on the consumer credit market in Poland. It sometimes occurs that the creditors abuse their position which leads to shaping the laws and obligations of the consumers to their disadvantage. They also do not fulfill their informational duties and due to this fact, in 2001 the legislator decided to introduce the sanction to the Polish law which deprives the creditors of the anticipated profit. The sanction of free credit aims to deter creditors from any violations so that an average consumer is put under protection from unreliable actions of creditors under consumer credit agreements. However, only quite recently one can see the tendency to put the sanctions into action by the courts. The aim of this paper is to analyze the sanction both in the doctrine and the judicature. The article asks the questions of the practical application of the sanction and stimulates the discussion about judiciary decisions in the matter.
