Abstract

Niniejszy artykuł stanowi próbę ukazania rozbieżności zachodzących pomiędzy przepisami postępowania egzekucyjnego a przepisami prawa pracy w zakresie pojęcia wynagrodzenia za pracę. W niniejszym opracowaniu poddano analizie dwa główne świadczenia, tj. periodyczne wynagrodzenia za pracę oraz wynagrodzenie za prace zlecone, a nadto egzekucje z wynagrodzenia prowizyjnego, nagrody, premii, zysku, udziału w funduszu zakładowym oraz szereg innych świadczeń wchodzących w skład egzekucyjnego wynagrodzenia za pracę. W artykule przywołano poglądy zaprezentowane w doktrynie oraz orzecznictwo sądowe, zwłaszcza Sądu Najwyższego.

This article is an attempt to present the discrepancies between the provisions of the enforcement proceedings and the provisions of the labour law concerning the remuneration for work. The paper analyses two main benefits, i.e. periodical remuneration for work and remuneration for commissioned works, as well as the enforcement of commission-based remuneration, awards, bonuses, profit, share in the company fund and a number of other benefits included in the remuneration for work under enforcement. The article refers to the views presented in the doctrine and judicial decisions, especially of the Supreme Court.
