Abstract

Przedmiotem rozprawy jest zagadnienie prawa oskarżonego do obrony formalnej podczas transgranicznego postępowania karnego, tj., każdego postępowania karnego, w którym pojawia się element współpracy między organami co najmniej dwóch państw członkowskich Unii Europejskiej. Analiza dokonywana jest pod kątem: prawnych i faktycznych możliwości korzystania przez oskarżonego z pomocy obrońcy podczas czynności podejmowanych przez polskie organy w związku z współpracą z organami innego państwa, ewentualnego roszczenia o zapewnienie oskarżonemu obrońcy z urzędu oraz, przede wszystkim, możliwości i uprawnień, z jakich obrońca może korzystać, realizując swoją funkcję. Rozważania obejmują przede wszystkim następujące zagadnienia: cele oraz charakter prawny działań podejmowanych przez organy poszczególnych państw w ramach międzynarodowej kooperacji, pojęcie obrony formalnej, prawne i faktyczne przesłanki jej efektywnej realizacji oraz możliwość jej skutecznego realizowania w transgranicznym postępowaniu karnym, podczas kooperacji, w świetle poszczególnych unormowań polskiej procedury karnej. Rozważania opierają się, co do zasady, na polskich regulacjach i doktrynie, uzupełniająco uwzględniają jednak różne koncepcje przyjęte w innych państwach członkowskich Unii Europejskiej, w szczególności w Anglii i Niemczech.

The thesis is concerned with the defendant’s right to counsel during transnational criminal proceedings, i.e. all criminal proceedings in which there’s cooperation between the organs of at least two EU Member States. It analyses the legal and factual ability of the defendant to be supported by a defence counsel during the proceedings run by the Polish institutions in cooperation with foreign institutions, potential claims for a public defender, and, above all, the options and powers that the defenders may use performing their function. The main issues discussed in this thesis include: the goals and legal status of the actions taken by the organs of particular countries in the framework of international cooperation, the concept of the right to be defended by a lawyer, legal and factual premises of an effective criminal defence and the possibilities to perform such an effective defence in transnational criminal proceedings in the context of particular regulations of the Polish criminal procedure. The dissertation is based on the Polish regulations and legal doctrine, but refers also to other concepts adopted in different EU Member States, Great Britain and Germany in particular.
