Right of defence is a collection of authorizations which are entitled to a passive party to the criminal process in order to refute charges, reduce criminal liability and other nuisance in criminal proceedings. This principle has its foundation in the Polish Constitution, the European Convention on Human Rights and the Code of Criminal Procedure. Pursuant to article 6 of the Code of Criminal Procedure, the right of defence is entitled to the suspect and the accused. Meanwhile, a suspected person - who formally is not a suspect - also participates in the criminal process, and the operations of the law enforcement authorities are focused around them. Most often, they become a party to pre-trial proceedings. The subject matter of the article is the right of defense from the suspected person point of view. For many years, they have remained unnoticed in the Polish legislation, even though they have been under doctrine consideration. This paper considers current proposals of a definition of the suspected person, and it also analyses the actual scope of the right of defense in terms of the constitution, conventions and statutes. This is a foundation in order to determine whether the suspected person in the current legal status has the right of defense, and whether it is properly exercised. De lege ferenda postulates have been also presented, i.e. a proposal of the definition of the suspected person and its placement in the Code of Criminal Procedure, as well as a suggestion for better realization of the right of defense in practice.

Prawo do obrony to zbiór wszelkich uprawnień, które przysługują stronie biernej procesu karnego w celu odparcia oskarżenia, zmniejszenia odpowiedzialności karnej oraz innych uciążliwości w procesie karnym. Zasada ta ma swoje podstawy w Konstytucji Rzeczpospolitej Polskiej, Europejskiej Konwencji Praw Człowieka oraz kodeksie postępowania karnego. Zgodnie z dyspozycją art. 6 k.p.k. prawo do obrony przysługuje podejrzanemu oraz oskarżonemu. Tymczasem w procesie karnym uczestniczy również osoba podejrzana, która nie jest formalnie podejrzanym, ale skupiają się wokół niej działania organów procesowych. Bardzo często staje się ona stroną postępowania przygotowawczego. Tematem artykułu jest kwestia prawa do obrony z punktu widzenia osoby podejrzanej. Od wielu lat pozostaje ona pomijana w polskim ustawodawstwie, chociaż była przedmiotem rozważań doktryny. W tekście poddano rozważaniom dotychczasowe propozycje na definicję osoby podejrzanej, a także przeanalizowano obecny zakres prawa do obrony w ujęciu konstytucyjnym, konwencyjnym i kodeksowym. Stanowi to bazę do ustalenia, czy osobie podejrzanej w obecnym stanie prawnym przysługuje prawo do obrony i czy jest ono odpowiednio realizowane. Przedstawione zostały również postulaty de lege ferenda – sformułowano propozycję definicji osoby podejrzanej i umiejscowienia jej w kodeksie postępowania karnego, a także sugestię dotyczącą lepszej realizacji prawa do obrony w praktyce.
