Abstract

Elastyczne formy zatrudnienia są podstawą zatrudnienia pracowników w wielu podmiotach komercyjnych. Ustawodawca celem zmniejszenia kosztów pracy umożliwił zastosowanie takiego rozwiązania również w przypadku spółdzielni. Takie rozwiązanie może być korzystne w przypadku wielu form spółdzielni poza spółdzielniami socjalnymi, które realizują zadania związane z reintegracją społeczną i zawodową swoich członków. Jako takie winny gwarantować stabilizację zatrudnienia oraz bezpieczeństwo ekonomiczne i socjalne czego niestety nie są w stanie zapewnić umowa zlecenie i umowa o dzieło. Tym samym dążyć należy do ich ograniczenia i prawnego z zakazu stosowania tego typu umów w spółdzielniach socjalnych w stosownej noweli właściwych przepisów. The flexible forms of work are one of the most important methods of employment in many commercial enterprises. A Polish Legislator prepared an identical solution also for cooperatives. It maybe useful for different types of cooperatives but not for social cooperatives which have specific influence for its members and local community. The main aim of social cooperatives is a social and vocational reintegration. They should build stable workplaces and social safety so management board have to use cooperative employment contract instead of a contract of mandate or specific task contract. As a result members of social cooperatives movement need to plan conclusions for Legislator in which they contain a ban of use flexible forms of employment in social cooperatives.
