TRASMISIÓN DE BIENES Y REGISTRO DE LA PROPIEDAD EN ESPAÑA (SEGUNDA PARTE)

Abstract

La circulación de los bienes en el tráfico jurídico por la voluntad de los particulares es un tema crucial que interesa, no sólo a las partes del contrato, sino, a todos en general, y, en particular, a los acreedores del transmitente o del adquirente y a los terceros adquirentes de derechos sobre el bien. En este trabajo se analizará el régimen de trasmisión de los bienes por negocio inter vivos en el Derecho español, dentro del marco europeo, y con particular referencia a la trasmisión inmobiliaria. España adopta un peculiar sistema de trasmisión de los bienes porque se establecen reglas genéricas cuya aplicación se da con independencia de la naturaleza mueble o inmueble del bien; pero a su lado se superponen otras que tratan de fijar los efectos de la publicidad registral inmobiliaria. La coordinación entre dichas reglas produce un original resultado, que puede constituir el punto de encuentro de los diversos sistemas registrales europeos.

Traffic of goods within the legal scope imposed by the will of the particularsis a core issue of interest, not only to the contract parties but to everyone, particularly to the transferor/acquirer creditors and to third partiesacquiring rights on the goods. The scope of this work is to analyze thetransfer of goods regime “inter vivos” within the Spanish Law, within theEuropean legal scope and with emphasis on the real state transfers. Spainhas adopted a peculiar transfer system, due to the fact that general rulesapply notwithstanding the immovable or movable nature of the good, and,additionally, other rules are superposed intending to establish the effectsthat derive from the real state register publicity. The coordination betweenthe above-mentioned rules produces an original result that may constitutethe meeting point of different European register systems.
