La ley modelo de arbitraje comercial internacional de la CNUDMI y su impacto en el orden jurídico venezolano

Abstract

This article must like objectives present some commentaries on the international commercial arbitration, summarize the general aspects of a law model, specially the Model Law on International Commercial Arbitration of the United Nations Commission on International Trade Law (UNCITRAL), and analyze its influence in the Law of Arbitration Commercial (LAC) of Venezuela. The investigation is descriptive, the documentary observation in primary and secondary sources is applied. One concludes that theLACpartially welcomes the postulates of theLMACI. TheLACis applied to the international arbitration, showing their monist character, takes care of kompetez-kompetez, the free determination of the place of the arbitration in the beginning and language, the separation of the arbitration body, the invalidity as only resource against I render, the recognition and execution of foreign lauds. To difference of theLMACI, it regulates the institutional arbitration and the measures you will prevent are decreed once constituted the by arbitration court.

Este artículo tiene como objetivos presentar algunos comentarios sobre el arbitraje comercial internacional, resumir las generalidades de una ley modelo, especialmente la Ley Modelo del Arbitraje Comercial Internacional (LMACI) de la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional (CNUDMI), y analizar su influencia en la Ley de Arbitraje Comercial (LAC) de Venezuela. La investigación es descriptiva, se aplica la observación documental en fuentes primarias y secundarias. Se concluye que la LAC acoge parcialmente los postulados de la LMACI. La LAC se aplica al arbitraje internacional, mostrando su carácter monista, atiende al principio kompetez-kompetez, la libre determinación del lugar del arbitraje e idioma, la separación del cuerpo de arbitraje, la nulidad como único recurso contra el laudo, el reconocimiento y ejecución de laudos extranjeros. A diferencia de la LMACI, la LAC regula el arbitraje institucional y las medidas cautelares se decretan una vez constituido el tribunal arbitral.
