El principio de culpabilidad es uno de los pilares que sustenta la actividad sancionadora del Estado. Esta máxima, al igual que los otros principios que presiden la actividad sancionadora de la Administración Pública, tiene una aplicación diferente de lo ocurrido en el campo penal, dado los intereses y bienes jurídicos que se persigue salvaguardar. Con ello nos referimos a la posibilidad de que se siga procesos sancionadores a una persona jurídica; a la merma del principio de culpabilidad, que puede llegar en ocasiones a aceptar la responsabilidad independiente de toda idea de culpa y a la viabilidad que se sancione a una persona por el hecho de otra.
The culpability principle is one of the basis supporting theState sanctioning activity. This principle, as well as the otherspresiding the Public Administration sanctioning activity has adifferent application to what happens in the penal area given theinterests and juridical goods to be protected. By this we wouldconsider the possibility to open sanctioning processes againstjuridical persons on detriment of the culpability principle,which could even get up to accept independent responsibilityin dependent of any culpability idea and the possibility for oneperson to be sanctioned instead of another one.
