El rol institucional de la corte constitucional

Abstract

La jurisprudencia constitucional sobre derechos sociales fundamentales, que en su gran mayoría conllevan intereses económicos, es una muestra de la transformación de la cultura tanto política como jurídica y su sensibilización respecto de las necesidades básicas y la prioridad política de tomarse en serio el reconocimiento efectivo de los derechos de las personas. Por otra parte, la jurisprudencia constitucional ha venido diseñando y poniendo en práctica una concepción moderna del Estado en la que el cumplimiento de los deberes sociales del mismo ocupa un lugar central en la reorganización de las instituciones públicas. Sin embargo, un cambio tan drástico conlleva indefectiblemente incongruencias y desfases en la política jurisprudencial de la Corte.

The Constitutional Jurisprudence about fundamentalsocial rights, most of which carry with them economicalinterests, is an example of culture transformation notonly political but legal and its sensibilization regardingthe basic needsand the politic priority of seriously takingthe effective acknowledgmentof people’s rights. On theother hand, the constitutional jurisprudence has beendesigning and putting into practice a mothern conceptionof the Statein wich the compliance of the State’s socialduties occupies a central place in the reorganization of thepublic institutions. Nevertheless, such a drastic changeunavoidably brings along incongruities and deferementsin the jusrisprudential politics of the Court.
