Abstract

El contrato de arrendamiento de bienes inmuebles constituye una de las modalidades contractuales de mayor impacto social en el contexto colombiano. En efecto, los gremios inmobiliarios nacionales (Fedelonjas y Camacol), relacionados con la actividad inmobiliaria, estiman que existen en el país cerca de 20’000.000 de inmuebles arrendados, destinados a servir de vivienda familiar, como unidad física para el funcionamiento de un establecimiento de comercio, como oficina para el ejercicio de una profesión y, en fin, para otras actividades relacionadas con el diario vivir de los colombianos. Este artículo pretende efectuar una revisión de la normativa relacionada con las obligaciones que adquieren las partes (arrendador y arrendatario) en el contrato de arrendamiento, en punto de la conservación, reparación y/o mejoras acaecidas en el inmueble arrendado, develando los vacíos e inconsistencias jurídicas que se constatan en la norma y formulando posiciones o puntos de vista para solucionar tales desafueros del legislador.

The lease of real estate is one of the contractual arrangements with a greatest social impact in the Colombiancontext. Indeed, the national real estate trade associations(Fedelonjas and Camacol), related to the property business,consider that in the country there are about 20.000.000leased buildings, they intended to serve as family housing,such as physical unit for the operation of a establishmentof trade, as an of?ce for the exercise of a profession andin order for other activities related to the daily lives of theColombian people.This article aims to conduct a review of the regulationsconcerning the obligations acquire the parties (lessor andlessee) in the lease, at the point of maintenance, repairand/or improvements occurring in the leased property,unveiling the gaps and legal inconsistencies were foundin the standard and formulating positions or viewpointsto solve such outrages of the legislature
