En este artículo se realiza un análisis de la posición de la Corte Constitucionalcolombiana, sobre la fuerza vinculante del precedente constitucional enmateria de control de constitucional y de tutela, a partir de la reseña deldesarrollo jurisprudencial que se le ha dado desde la creación en 1991 dela Jurisdicción constitucional. El análisis se orienta a poner de presente elconflicto existente sobre las fuentes del derecho, desde un análisis históricode la rigidez constitucional y el papel de los tribunales constitucionales.

In this article it is realized an analysis of the position of the ConstitutionalColombian Court, on the binding force of the constitutional precedent asfor control of constitutional and of guardianship, from the review of thejurisprudential development that it has been given since the creation in1991 of the constitutional Jurisdiction. The analysis is orientated to present the existing conflict on the Sources of Law, from a historical analysis of the constitutional inflexibility and the role of the constitutional courts
