LA INSOLVENCIA TRANSFRONTERIZA EN EL DERECHO COLOMBIANO

Abstract

Este artículo presenta una exposición de la insolvencia transfronteriza y de cómo dicho fenómeno ha sido tratado en el ordenamiento jurídico colombiano, especialmente en la Ley 1116 de 2006 o Nuevo Régimen de Insolvencia Empresarial, y luego efectúa un análisis de las disposiciones actualmente vigentes y cuáles pueden ser su utilidad e implicaciones a futuro en el Derecho. El objetivo de este trabajo es realizar una valoración de la incorporación de las normas de la Ley Modelo de la CNUDMI sobre la Insolvencia Transfronteriza en el ordenamiento jurídico colombiano, poniendo de relieve tanto las ventajas como las falencias.

The author exposes how the cross-border insolvency has been treatedin Colombian Law, especially in Law 1116 of 2.006, known as newColombian Insolvency Regime. Then, he analyzes the utility and futureimplications of those rules. The objective of this article is to make anevaluation of the positive and negative aspects of the incorporation ofUNCITRAL Model Law on Cross-Border Insolvency in Colombian Law
