Entender la compraventa como el más usual y común de los contratos equivale a afirmar que éste es el elemento que permite la mayoría de las transacciones que se hacen entre particulares, comerciantes y empresarios, y que, por lo tanto, se hace necesaria una protección especial para los derechos de los compradores; protección que tiene que ver con el saneamiento por vicios ocultos consagrado desde el Código Civil, pasando por la presunción de garantía de funcionamiento, consagrada en el Código de Comercio, y llegando a su máximo desarrollo en las normas de protección al consumidor. El objetivo de este trabajo es hacer un breve pero completo análisis de estas instituciones, haciendo énfasis en su regulación y diferencias sustanciales y procesales.
The understanding of the buy-sale process as the most common of contracts is equal to state that it is the fabric that facilitates most of the transactions between common people, dealers and entrepreneurs. It is because of this that it is needed special protection for the buyer’s rights, as is the case of solving hidden defects cases in the civil code, the guarantee of proper working in the code of commerce, and the laws of protection to the consumer.The purpose of this paper is to present a brief but complete review of these institutions, making special emphasis on its regulation and their substantial and processal differences.
