El objeto de este trabajo es analizar la regulación del error en los instrumentos normativos del Derecho contractual europeo. En particular, se estudia el régimen jurídico del error en la propuesta de Reglamento sobre un Derecho común europeo de la compraventa (CESL), pues esta propuesta aglutina, en buena medida, las reglas fundamentales sobre los vicios de la voluntad previstas en los Principios del Derecho europeo de contratos (PECL) y el Borrador del Marco Común de Referencia (DCFR), confirmando así la tendencia del moderno Derecho de contratos en esta materia.
This paper aims to analyse the regulation about the mistake on the instruments of European contract law. Particulary, this paper study the rules in the proposal for a regulation on a Common European Law of Sales rules (CESL), because this proposal binds toghether, mostly, the fundamental rules about defects in consent of the Principles European contract law (PECL) and the Draft Common Frame of Reference (DCFR), confirming in that way the tendency of the modern contract law.
