Abstract

El presente Trabajo Fin de Grado aborda, desde una visión general, los aspectos más destacados de la nueva regulación legal de los sistemas de protección civil y seguridad nacional recientemente aprobados y de la configuración básica de los estados excepcionales de nuestro Derecho de excepción. Trata, por tanto, de intentar ofrecer las principales figuras e instrumentos jurídicos que rodean a la protección civil, a los estados de excepción y a la seguridad nacional, especialmente en lo que a sus concomitancias, interdependencias y diferencias se refiere. El contenido básico del estudio queda dividido en dos partes netamente diferenciadas. La primera parte, orientada a la protección civil, comprende el análisis de los aspectos más relevantes de la nueva Ley 17/2015, de 9 de julio, del Sistema Nacional de Protección Civil, vigente desde el 10 de enero de 2016, con especial incidencia en los derechos y deberes de los ciudadanos, en el modelo básico de la planificación en esta materia y en las denominadas «emergencias de interés nacional». La segunda parte, abarca los aspectos fundamentales de los estados de alarma, excepción y sitio configurados por la Ley Orgánica 4/1981, de 1 junio, y los aspectos más notables de la nueva Ley 36/2015, de 28 de septiembre, de Seguridad Nacional, vigente desde el 30 de septiembre de 2015.

This dissertation tackles the current legal regulation highlights of civil protection and national security systems recently approved in Spain and the basic configuration of the Spanish Exception Law. The project attempts to provide the main legal figures and instruments of the civil protection, national security and states of exception, especially their interdependencies and differences. The basic content of the study is structured in two parts. The first part reviews thoroughly data of the new Act 17/2015 on Civil Protection National System, in force since January 10th 2016, with special emphasis on the rights and duties of citizens, on the planning scheme and on the national emergencies. The second part comprises the fundamentals of the state of alarm, emergency and siege set by the Organic Act 4/1981 and the most notable aspects of the new Act 36/2015 on National Security, in force since September 30th 2015.
