El cohecho en consideración al cargo o función

Abstract

La monografía tiene por objeto el tradicionalmente llamado cohecho impropio, si bien resulta preferible denominarlo cohecho en consideración al cargo o función, previsto en el art. 422 del Código Penal. Contiene un índice prolijo, elaborado así con la finalidad de permitir la búsqueda rápida de cuestiones concretas que puedan resultar de especial interés para el lector. La obra aborda todos los aspectos concernientes a esta modalidad delictiva, lo que obliga a detenerse en elementos comunes del delito de cohecho en general, o de los cohechos pasivos en particular, lo que amplía el ámbito de interés del trabajo (caso de lo que debe entenderse por funcionario público, o por dádiva). Cada uno de los elementos típicos son analizados pormenorizadamente, dando cuenta de los debates doctrinales que se hayan generado, de interés no solo teórico, sino también para los prácticos del Derecho, dadas las distintas posiciones procesales en que pueden encontrarse. El estudio va acompañado de la jurisprudencia de la Sala 2ª del Tribunal Supremo que resulta de interés, advirtiendo, incluso, sus pronunciamientos contradictorios.
