Se analiza en el presente trabajo si el ejercicio de los deberes correspondientes a la patria potestad, en especial, el del cuidado y de educación de los hijos, puede legitimar circunstancialmente una intromisión en los derechos a la intimidad y al secreto de las comunicaciones de estos últimos, atendidas las circunstancias de tratarse de derechos fundamentales que solo son ejercitables por sus titulares, aun cuando sean menores de edad. Junto al marco teórico-dogmático, se recogen ciertos criterios derivados de diferentes resoluciones judiciales en esta materia que, por su importancia y trascendencia pueden arrojar luz a la hora de formular un principio decisorio con el que enfrentar estos conflictos.
This paper analyzes if the exercise of specific duties of parental authority, basically the care and education of children can circumstantially legitimize an interference in the rights to privacy and the secrecy of the communications of those children, in view of the fundamental nature of these rights, that allow to be exercised only by their holders, even if they are minors. Together with the theoretical-dogmatic framework, we expose some judicial decisions that given its importance and transcendence, they can shed some light for build a decision rule to face these issues
