Turismo reproductivo transfronterizo

Abstract

Los avances en las técnicas de reproducción humana asistida (TRHA), han hecho posible satisfacer el deseo de paternidad de todos los colectivos que conforman los nuevos modelos de familias. En España dichas técnicas se regulan con la Ley 14/2006, de 26 de mayo, siendo una de las más permisivas, convirtiendo a nuestro país en líder europeo de turismo reproductivo, incrementado por las legislaciones restrictivas de otros países. También, influye la experiencia de los profesionales, el gran número de clínicas en todas las ciudades y la calidad asistencial. Sin embargo, esta ley excluye la gestación subrogada, razón por la cual, muchos españoles realizan viajes transfronterizos buscando una legislación que se amolde a sus necesidades, desplazándose mayoritariamente a Estados Unidos; que ofrece las máximas garantías, teniendo en cuenta que cada estado regula con sus propias leyes. Ucrania, hasta hace poco era el destino preferido por sus bajos precios. Actualmente, el gobierno de España ha paralizado las inscripciones de los menores, debido a continuas denuncias por explotación y tráfico de bebés. La técnica de gestación subrogada, es la que genera mayor controversia; existen argumentos contra la explotación sobre las mujeres más vulnerables de los países pobres y la mercantilización del cuerpo. Además, de los estándares que se exigen para crear un bebé por encargo, generando un negocio millonario en la industria del turismo reproductivo.

Advances in assisted human reproduction techniques (AHRT), have made it possible to satisfy the desire of paternity of all the groups that make up the new family models. In Spain these techniques are regulated by Law 14/2006, of May 26, being one of the most permissive, making our country a European leader in reproductive tourism, increased by the restrictive laws of other countries. It also influences, the profesional experience, the large number of clinics in all cities and the quality in attendance. However, this law excludes surrogate pregnancy, reason why, many Spaniards make cross-border trips looking for a legislation that fit their needs, mostly moving to the United States; that offers highest guarantees, taking into account that each state regulates with its own laws. Ukraine until recently was the preferred destination for its low prices. Currently, the government of Spain has paralyzed the registration of minors, due to continuous complaints of exploitation and trafficking of babies. The surrogate pregnancy technique, is the one that generates the most controversy; there are arguments against exploitation of weaker women from poor countries and the commodification of the body. As well as the standards required to create a custom-made baby, generating a millionaire business in the reproductive tourism industry.
